Family-Based Green Cards

Permanent residency based on sponsorship by a U.S. citizen parents, spouse, child or sibling

Foreign citizens of certain U.S. citizen relatives are eligible for green cards. The type of relationship will dictate whether and when you can become a permanent resident.

 

Immediate Relatives Category

  • Spouses of U.S. citizens
  • Parents of U.S. citizens over the age of 21
  • Children of U.S. citizens under the age of 21

Priority dates for foreign nationals under one of these categories are current, meaning that they are immediately eligible for U.S. permanent residency.

Family preference category

The other category is known as “family preference,” which allow a U.S. citizen relative to sponsor: 1) unmarried sons or daughters (over 21) of U.S. citizens; 2) married children of U.S. citizens who are of any age; 3) brothers and sisters of U.S. citizens who are over 21; and 4) spouses or children of U.S. permanent residents.

Wait times under the family preference category vary, depending on whether a priority date is current.  You can check your priority date by visiting the Department of State’s Visa Bulletin here.
